These Terms of Service (“Terms”) govern your access to and use of the Checki mobile application, web platform, and related services (collectively, the “Service”), operated by Checki LLC (“Checki,” “Company,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service.

If you use the Service on behalf of a company, landlord entity, brokerage, or other organization, you represent that you have authority to bind that entity to these Terms.

3. Description of Service

Checki provides digital tools for property inspections, including:

Creating inspection reports
Uploading and storing photos, videos, notes, and signatures
Generating downloadable inspection documents
Sharing inspection reports with third parties

Checki does not provide licensed home inspection services, legal advice, building code certification, or regulatory compliance services.

You are solely responsible for ensuring your inspections comply with applicable laws.

4. Account Registration

To use certain features, you must create an account.

You agree to:

Provide accurate and current information
Maintain the confidentiality of login credentials
Accept responsibility for all activity under your account

We may suspend or terminate accounts for violations of these Terms.

5. Subscriptions & Payments

Checki offers paid subscription plans.

Pricing is displayed within the App or website.
Subscriptions automatically renew unless canceled before renewal.
You may cancel through your account settings.
Fees paid are non-refundable except where required by law.

Failure to pay may result in suspension or termination of access.

EU/EEA/UK Right of Withdrawal

If you reside in the European Union, EEA, or United Kingdom and purchase a subscription:

You may have a statutory 14-day right of withdrawal.

However, by starting to use paid features immediately after purchase, you expressly request immediate performance of the Service and acknowledge that you may lose your right of withdrawal once the Service has been fully performed.

6. Acceptable Use

You agree not to:

Use the Service for illegal purposes
Upload false, fraudulent, or misleading inspection information
Interfere with or disrupt the Service
Reverse-engineer or copy the software
Attempt unauthorized access to systems

We reserve the right to suspend accounts for misuse.

7. User-Generated Content

You retain ownership of inspection data, photos, notes, videos, and documents you upload (“Content”).

You grant Checki a non-exclusive, worldwide, royalty-free license to:

Host, store, process, and display your Content
Generate reports
Provide customer and technical support

You are responsible for the legality and accuracy of your Content.

8. Data Protection & Privacy

Your use of the Service is also governed by our Privacy Policy.

For EU/EEA/UK Users (GDPR)

If you are located in the EU/EEA/UK:

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable UK data protection laws.

You have rights including:

Access
Rectification
Erasure
Data portability
Restriction of processing
Objection

Data may be transferred to the United States under appropriate safeguards.

9. Intellectual Property

All software, branding, features, and materials provided by Checki are owned by Checki LLC or its licensors.

You may not copy, modify, distribute, sell, or create derivative works without written permission.

10. Third-Party Services

The Service may integrate third-party services such as:

Cloud hosting providers
Payment processors
Analytics providers

We are not responsible for third-party services.

11. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, Checki disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

12. Limitation of Liability

United States Users

To the maximum extent permitted by U.S. law:

We are not liable for indirect, incidental, consequential, or punitive damages.
Our total liability is limited to the amount you paid in subscription fees during the 12 months preceding the claim.

EU/EEA/UK Users

Nothing in these Terms excludes liability that cannot be excluded under mandatory consumer protection laws.

13. Indemnification

You agree to indemnify and hold harmless Checki LLC from any claims, damages, or losses arising from:

Your use of the Service
Your Content
Violation of these Terms
Misuse of inspection reports

14. Termination

We may suspend or terminate your access if:

You violate these Terms
Payment fails
We discontinue the Service

Upon termination, your right to use the Service immediately ends.

15. Governing Law & Jurisdiction

For Users Located in the United States

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any disputes shall be resolved in the state or federal courts located in Florida.

For Users Located in the European Union, EEA, or United Kingdom

These Terms are governed by the laws of your country of residence.

You retain all mandatory consumer rights provided under applicable EU/EEA/UK law.

16. Changes to These Terms

We may update these Terms from time to time.

Changes become effective when posted.

Continued use of the Service after changes means you accept the updated Terms.
